How To Excercise American Constitutional Rights When Arrested
70"Many of the rights in the Constitution and the Bill of Rights, such as habeas corpus, the right to remain silent, and the right to an attorney, are designed to ensure that those accused of a crime are assured of those rights." (source: US Consitution Online)
You Have The Right To Remain Silent. So Do it!
Seriously, with the exception of giving your name and address, do not say a word!
The police are trained in the good guy bad guy thing and will do any and everything to get you to talk.
Anything You Say Can and Will Be(twisted, manipulated and..) Used against you in a Court of Law!
Even if you say BOO it will be turned into BOO HOO. Get it? So remain silent, stay calm and continue exercising your right for an attorney.
After they receive your information to run your name with they will then go on a witch hunt to find any and everything they can to attempt to build a case against you.
It's their job to help the district attorney get convictions and look good for re-election.
When arrested the law requires the officers to recite the following ( if you do not understand have the officer explain. Do not simply answer yes if you do not fully understand.)
"You have the right to remain silent and refuse to answer questions. Do you understand?
Anything you do say may be used against you in a court of law. Do you understand?
You have the right to consult an attorney before speaking to the police and to have an attorney present during questioning now or in the future. Do you understand?
If you cannot afford an attorney, one will be appointed for you before any questioning if you wish. Do you understand?
If you decide to answer questions now without an attorney present you will still have the right to stop answering at any time until you talk to an attorney. Do you understand?
Knowing and understanding your rights as I have explained them to you, are you willing to answer my questions without an attorney present?"
When asked the previous question say this - No Sir, I am not willing to answer any questions without an attorney present. It is here that the officer will start in with how important it is to co-operate. Don't let him fool you he is just trying to get you to incriminate yourself.
Once placed in the car on the ride in to jail the officer will try everything he can to get you to talk. He will talk about the stars in the sky, the traffic, or what ever he can think of. If you answer him you will have to immediatly repeat your wish to have an attorney and then seal your lips once again. Every time he gets you to say something you have waived your right again. Be quiet. Don't let em trick you, don't answer any of their questions. Do not resist arrest , simply state your right to an attorney and repeat that right like a broken record every single time they ask you a question.
What To Do Once Arrested
Be polite and as courteous as possible.
Do ask if you are under arrest. If you are, you have the right to be told why.
When you are arrested, demand the right to have an attorney present before speaking to the police.
Ask for the police officer's name and badge number, or read it off of his or her badge and remember it.
Get a good look at the officer's face so that you can identify him later.
If you are arrested in your car, show the police officer your driver's license and registration information.
As soon as you can, write down everything that happened during the course of your arrest you can use that to refresh your memory at a later date.
If you are physically injured by the police, seek medical attention, inform your medical providers of the cause of your injuries. Take photographs of your injuries as soon as possible.
Remember, (I can't say this enough) you do not have to answer ANY question that the police ask of you. If you answer a question which at first seems harmless, be aware, it WILL come back to haunt you.
Arrested For Attempting To File Complaints
What Not To Do Once Arrested
With the exception of your name, date of birth and address do not offer any information to the officers no matter what tactics they use.
Do not assume that the officers have a search warrant just because they say that they do. If they say they have a search warrant, ask to see it.
The officers will try to bait you into losing your temper so do not get into an arguement with them.
Do not give the officers any reason to find you threatening. Do not give them the impression that you are hard to deal with or irrational.
Do not resist arrest. Even if you think you are innocent, the time to protest comes later. If you resist arrest, you may face additional charges.
Do not allow officers to listen in on any telephone call that you make to your lawyer once you have been arrested. While the police may listen in on conversations to other individuals, they cannot listen to a conversation with your lawyer because it is protected by the attorney-client privilege.
The officers will call you un cooperative if you do not speak to them. This is a scare tactic Do not speak to them about anything before your attorney is present.
Here is a biggie - Do not, I repeat do not sign anything, no matter what it is, without your attorney being present.
A Quick Summary
Continue to exercise your right to an attorney no matter how un cooperative the officers say you are and....
Don't sign anything!
Don't let them scare you with their crooked tactics be aware it's their game and ignore it.
Wait for your attorney and he will be happy to come get you out of jail - it will be a whole lot simpler for him if you haven't answered questions or signed any papers.
